1. Acceptance of Terms

By accessing and using Life Diary ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Life Diary is a digital memory chain application that allows users to:

• Upload and store images, videos, GIFs, and text notes
• Create an immutable blockchain-like chain of memories
• Visualize their memory chain using interactive diagrams
• Export and import their complete memory data
• Choose between cloud storage (Backblaze B2) or database storage

3. User Accounts and Authentication

To use our Service, you must:

• Create an account using Google OAuth authentication
• Provide accurate and complete information
• Maintain the security of your account credentials
• Be responsible for all activities under your account

4. Data Storage and Privacy

Your data is stored securely using:

• MongoDB database for metadata and chain structure
• Backblaze B2 cloud storage for file content (if cloud storage is selected)
• SHA256 hashing for data integrity verification
• Encrypted connections for all data transmission

Each user's memory chain is completely private and isolated from other users.

5. User Content and Responsibilities

You are solely responsible for:

• All content you upload to the Service
• Ensuring you have the right to upload and store such content
• Complying with all applicable laws and regulations
• Not uploading illegal, harmful, or inappropriate content
• Respecting the privacy and rights of others

6. Modesty and Explicit Content Policy

Life Diary is intended for respectful, personal memory keeping. Do not upload nudity, sexually explicit or pornographic content, vulgar or obscene imagery, fetish content, or images designed for sexual arousal. Content featuring minimal clothing such as bikinis or lingerie is not allowed when it is sexualized, revealing in a suggestive manner, or when the overall context is adult-oriented. If in doubt, do not upload the content.

We also prohibit content that exploits or endangers anyone, depicts minors in sexualized contexts, promotes hate or violence, or violates applicable laws. You are responsible for ensuring all uploads comply with these rules and with community norms of modesty and respect.

We may remove any content or entire chains that, in our sole discretion, violate these policies or that are reported by other users as inappropriate. Repeated or severe violations may lead to account suspension or termination.

7. Prohibited Uses

You may not use our Service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code

8. Payment Terms

Our Service offers both free and paid subscription plans:

• Free Plan: Limited storage and features
• Plus Plan: Enhanced storage and features
• Pro Plan: Maximum storage and premium features

Payments are processed securely through Paddle. Subscription fees are billed in advance on a monthly or annual basis.

9. Refund Policy

How to Request a Refund:

• Contact us within 14 days of your subscription purchase
• Provide your account email and subscription details
• Refunds are processed within 5-7 business days to your original payment method

Important Notes:

• The 14-day refund window applies to the initial purchase only, not to renewal charges
• Refunds for subscription renewals are handled on a case-by-case basis
• After requesting a refund, your account will be downgraded to the Free plan
• You can cancel your subscription at any time to prevent future charges, even without requesting a refund

Refunds are issued through Paddle, our payment processor. All refund requests are subject to Paddle's refund processing policies.

10. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of Life Diary and its licensors. The Service is protected by copyright, trademark, and other laws.

You retain ownership of all content you upload to the Service. By uploading content, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service.

11. Data Export and Portability

You have the right to export all your data at any time. We provide tools to download your complete memory chain in JSON format. You can also import previously exported data to restore your memories.

12. Service Availability

We strive to maintain high service availability but cannot guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect service availability.

13. Limitation of Liability

In no event shall Life Diary, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

14. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

16. Governing Law

These Terms shall be interpreted and governed by the laws of the United States, without regard to its conflict of law provisions.
